Anna Nicole Smith’s ex-boyfriend, Larry Birkhead, who claims to also be the father of her baby girl said he hopes to see the infant soon as he entered a Bahamian courthouse for a three-way custody battle.”I hope to get to see her and have her soon,” Larry Birkhead told reporters outside the Supreme Court building. Others expected to seek custody in the closed session are Smith’s estranged mother, Virgie Arthur, and Smith’s companion, Howard K. Stern, who is listed as the baby’s father on the birth certificate. Arthur arrived after Birkhead. Asked why Arthur deserved custody, her attorney Deborah Rose said simply: “She’s the grandmother.”The 5-month old baby, who was born in the Bahamas, is staying at a gated, waterfront mansion in Nassau where Smith lived with Stern until she died. Arthur has said she could provide a more stable home than Stern and should therefore be awarded custody of the baby, who could inherit a fortune. Stern returned to Nassau from Florida over the weekend but was not seen outside the courthouse. Thomas Evans, a prominent Bahamas attorney, said there is no specific provision in Bahamian law for a paternity claim based on DNA.”The court could determine that any of those seeking to be the guardian of the child, or even another party, including the country’s Department of Social Services, should have custody, based on the best interests of the child,” he said. In another Nassau courtroom, a separate hearing was scheduled in a dispute over the waterfront mansion, known as “Horizons.” G. Ben Thompson, a South Carolina developer who briefly dated Smith, says he advanced her money for the $900,000 house but she did not honor an agreement to pay the mortgage. She had claimed the house was a gift. An attorney for Thompson, Godrey Pinder, said regardless of any court decision, he would not try to immediately evict Stern out of concern for the infant .”We want to be concerned about the baby,” he said. “We don’t want to hurt her, so whatever is reasonable.”

Us Weekly reports Angelina Jolie and Brad Pitt are planning to adopt a Vietnamese boy, and have already filed the adoption papers. The two visited the Tam Binh orphanage in November and Angelina returned alone last month. A source says:

“Angelina and Brad have filed papers with the US Citizenship and Immigration services to adopt a boy from the Tam Binh orphanage in Ho Chi Minh City.”

Dave Navarro and Carmen Electra are officially divorced. The ex-couple’s split was finalized in Los Angeles Superior Court. Electra and former Jane’s Addiction guitarist Navarro will split their assets and personal belongings according to a premarital agreement, court papers show. They will waive spousal support. Electra’s publicist announced in July that the childless pair was amicably separating. Electra cited “irreconcilable differences” for the break in court papers filed in August. Sources have confirmed Britney Spears has returned to the Promises Malibu Treatment Center. The center specializes in treating drug and alcohol abuse. Her mother Lynn reportedly drove her to the center.Meanwhile, the emergency custody hearing that Kevin Federline wanted has been canceled because of the new development. There will be no custody hearing today. Sources claim Federline is concerned for Spears’ welfare and wants her to get the help she is now seeking. This may be Spears’ last chance, if she leaves rehab before getting full treatment, Federline will immediately go to court seeking orders allowing him unquestioned full custody of the children. A source claims that Spears showed up at Federline’s house to see the boys last night and he wouldn’t let her in. The kids are now in the custody of Federline, and have been since last week.Spears and Federline reportedly agreed that he would keep their two young children while Spears was in rehabilitation. Spears’ inpatient rehab program is supposed to last between 30 and 45 days.

Stephen Tunstall, the attorney for Smith’s estranged mother, Virgie Arthur, called the document a “phantom will,” saying it is not valid because it was not filed in court. The will was released hours after a judge approved the embalming of Smith’s remains and tried to broker an agreement among the three people fighting over her body. Lengthy legal fights still loomed over where she will be buried and who will get custody of her daughter. A hearing over Smith’s final resting place was in its third day when it stopped for the holiday weekend. The hearing was to resume Tuesday.Stern is trying to get control of Smith’s remains, as is Arthur. Larry Birkhead hopes Smith’s DNA will help prove he fathered her baby even though Stern is listed as the father on the girl’s birth certificate.

Developer Sues Hilton
Nicky Hilton is being sued by a Chicago development group for breach of contract over a hotel renovation project in her name. She is accused of not keeping her end of a April 2006 agreement to promote the redevelopment of ‘Nicky O’s Chicago,’ a Nicky Hilton hotel. Robert Falor Investments and Grand USA Hotel Supply also claim Hilton contracted out interior design work she was supposed to perform and tried to charge it back to the developer. Paul Fisher, Hilton’s agent, is also named in the lawsuit. Elliot Mintz, a media representative for Hilton, says, “Things are not always as they appear. When the facts surrounding this matter are known to the public I think you will find out that the person who has been most impacted by this action will be Nicky Hilton. In the meantime, I don’t think anybody should draw any conclusions based on the simple filing of a lawsuit.”
