Stern Appeals Ruling
Anna Nicole Smith’s longtime lawyer and companion is appealing a judge’s directive for a DNA swab test on her 6-month-old daughter, the subject of a custody battle in the Bahamas, legal sources said. But Court TV reported the mouth swab test had already been done and would be sent to a laboratory in Ohio. The legal sources, who asked not to be identified, said lawyers for Howard K. Stern were drawing up papers to block Judge Stephen Isaacs’ directive that a swab be taken from the infant..”It was hoped the appeal would be heard, but, the situation being what it is here in the Bahamas, it’s unlikely it will be heard until next week,” a source said. “I gather they are shooting for Monday.” The paternity lawsuit was brought in the Bahamas by Larry Birkhead, an ex-boyfriend of Smith, whose sudden death in Florida on Feb. 8 touched off a custody battle for her daughter. Birkhead, a Los Angeles photographer, said he is the father of the baby who is heir apparent to Smith’s estate. The estate could be worth hundreds of millions of dollars if it wins a fight to inherit from Smith’s late oil tycoon husband, J. Howard Marshall. Miss USA Apologizes
Tara Conner says she’s sorry and wants to make amends as her tumultuous reign comes to an end. In an interview with Matt Lauer on ‘TODAY’, she said that earlier she met with the 51 young women currently competing for her crown and told them how sorry she is for what she’s done.”I apologized to all of them for everything they had to go through. It was something everyone had to deal with,” she said, referring to the fallout from revelations in December that she had been drinking and doing drugs. Angelina Jolie and her newly adopted 3-year-old son and his new brother and sister left Vietnam in a private jet en route to the boy’s new home in the United States.Jolie adopted Pax Thien Jolie in Ho Chi Minh City last week, but they later came to the capital city of Hanoi to pick up a visa and passport allowing him to enter the United States. Jolie left a pack of disappointed paparazzi in her wake, fleeing from them before boarding the awaiting Gulfstream jet with her children at Noi Bai Airport. During her week in Vietnam, Jolie spent her time with her children in hotels, shielding Pax from the photographers that trailed them everywhere. Most were unaware that Jolie had not only brought Maddox to meet his new brother, but she had also brought Zahara to Vietnam as well. Producer Dallas Austin has apologized to Christina Aguilera and Joss Stone after claiming they offered to perform sexual favors in exchange for his work on their albums. In an interview with Rowdy TV, Grammy-winning Austin accused them of being so desperate to work with him, they would offer their bodies to him and his friends, including Aguilera’s now husband Jordan Bratman. He made crude comments about Christina Aguilera and Joss Stone claiming they wanted him to work with them on their albums. However, Austin has now apologized for his remarks. Drew Barrymore and Hugh Grant are among the latest group of celebrities to be warned they may have contracted the liver disease Hepatitis A from an infected member of a catering staff. They have been alerted of the threat by a letter from the Los Angeles County Department of Public Health. The warning comes after health officials were alerted to a sick member of celebrity chef Wolfgang Puck’s catering staff, who may have inadvertently infected guests at a party following the launch of their new movie ‘Music & Lyrics’ on February 7th. The letter asks party guests to contact health officials or doctors if they ate uncooked food served at the event. The health officials list items from the “Mini Potato Skins Bar, the Taco/Fajita Bar and the 80’s Comfort Station” among the potentially contaminated items. Sandra Bullock and Adam Brody, who were also among the guests at the party, have received the letter. The latest health alert comes after Beyonce Knowles and the supermodel stars of the Sports Illustrated Swimsuit Issue were urged to get health checks last month after attending another Puck party, which featured the unnamed Hepatitis A carrier among the catering staff. Puck’s staff reportedly catered fourteen celebrity events since the beginning of the year. They had previously refused to name those events.

Heather Mills has remained tight-lipped about media reports that she and estranged husband Paul McCartney are close to a divorce settlement worth $56million. According to tabloid reports, Mills has agreed to a deal offered by McCartney that she would give her cash and property to the combined value of $56million. The terms of the settlement also give her joint custody of their three-year-old daughter. Mills’ legal team denied the report. Neither of the couple’s lawyers has confirmed the latest allegations. The couple had not signed a prenuptial agreement before their 2002 marriage so Mills could have received a quarter of McCartney’s $1.6-billion fortune. Birkhead Files Again
Larry Birkhead was back in a Los Angeles courtroom asking a judge for a DNA test to determine the real father of Anna Nicole Smith’s baby. Birkhead and his lawyer Debra Opri were in court to try and force Smith’s lawyer and companion, Howard K. Stern, to take a paternity test. Stern’s name is listed on the birth certificate, but Birkhead has been fighting since last October to prove he is the baby’s biological father. Birkhead claims, “I know where I was and I know where Anna was. I think it’s unfortunate that it’s becoming a circus. One of the reason’s it’s become a circus is because no one has brought the baby forward to do the test. There’s one way to end it. I’m prepared to take the test and if everyone wants to take the test and get it over with, we have no problem.” “Superior Court Judge Robert Schnider refused to make Stern a part of the paternity court action but said he would review the matter in two weeks after he considers the law more closely,” Opri said. Stern’s lawyers maintain their client is not required by law to take a test and doesn’t have to prove anything because he is the person listed as the father on the baby’s birth certificate. Opri said she was confident Stern would be forced to come back to California for the test adding, “He can’t hide behind a fake birth certificate.”

Driver Avoids Deportation
Yoko Ono’s former driver, who pleaded guilty to trying to extort money from her, can leave the United States voluntarily rather than be deported, a federal immigration judge decided. Koral Karsan can return to his native Turkey without further legal proceedings under an order signed by Judge Alan Vomacka. Karsan must leave the U.S. by April 13. “He has a plane ticket to Turkey for March 23,” his lawyer Jonathan Avirom said. The voluntary departure resulted from an agreement between Avirom and Department of Homeland Security attorney Victor Yee. It makes Karsan’s re-entry into the United States less difficult than if he were deported. Karsan was arrested in December and accused of trying to blackmail Ono for $2 million. He threatened to release embarrassing recordings and photos of her and possibly have her killed. Karsan pleaded guilty on Feb. 16 to attempted grand larceny, admitting he told Ono she had to pay him “more than $3,000″ to stop his plan. He was sentenced to 60 days in jail, which was covered by the time he had already served. Karsan then was turned over to immigration officials. Karsan’s criminal trial lawyer, Robert Gottlieb, maintained after Karsan’s plea that he was an aggrieved employee “who was sexually harassed” and otherwise abused by Ono and had been demanding compensation, not trying to blackmail her.

Publisher Stops Book
Crown Publishing pulled the plug on a reportedly “explosive” tell-all being written by Madonn’s former nanny, Melissa Dumas, the author’s agent revealed. Madonna’s lawyers had reportedly pressured the publisher to drop “Live to Tell: My Life as Madonna’s Nanny.” The book was reportedly expected to expose details of Madonna’s marriage to film director Guy Ritchie, her alleged ironfisted household rules and the controversial adoption of her Malawian son.”I deeply regret that Crown decided not to move forward in publishing the nanny’s book,” agent Sharlene Martin said in a statement. Madonna’s rep Liz Rosenberg declined to comment on the proposed book or reports that Madonna’s lawyers exerted pressure to quash the book. The ex-nanny “had very little already on paper, it was very much a work in progress” when Crown pulled the plug, says a source. Crown may have had second thoughts because the book was likely to take longer to complete than originally expected, especially the process of legal challenges, publishing insiders said.

Angelina Jolie arrived in Ho Chi Minh City, Vietnam where she plans to adopt a 3-year-old boy. Airport security officials told a photographer working for The Associated Press that Jolie was whisked into a car with dark windows and driven away.Jolie was expected to attend an adoption ceremony with Vietnamese officials in Ho Chi Minh City, according to adoption officials, speaking on condition of anonymity. After she receives the child, Jolie will meet with U.S. consular officials, who must review the adoption before a passport can be issued for the boy. “If all goes according to plan, Jolie could bring the child home by the weekend,” officials said. The boy has been living at the Tam Binh orphanage on the outskirts of Ho Chi Minh City since he was abandoned at a hospital as an infant, according to adoption officials. Shortly after he arrived at the orphanage, the Tam Binh staff tried unsuccessfully to locate the boy’s birth parents. “The boy is healthy, friendly and a little bit shy,” they said. “He gets along well with other children and loves to play soccer.” Jolie filed adoption papers as a single parent, because she and her partner, Brad Pitt, are not married. The couple met the boy when they made a surprise visit to the Tam Binh orphanage in Ho Chi Minh City, Vietnam at Thanksgiving.

Sanitation Chief Albert Durrell has some advice for Naomi Campbell, who’s set to serve five days of community service next week at the lower East Side garage where he works.”Hopefully, she’ll know not to come in high heels or anything like that,” Durrell said. That changed after current ‘American Idol’contestant Antonella Barba was allowed to stay on the show despite the emergence of racy online photos that were of Barba, especially the latest photos of her posing in the fountain at the WWII Memorial. The first big controversy of the show’s sixth season appeared when fans and a civil-rights activist rallied to Davis’ side, saying she was the victim of unfair and potentially biased treatment.”I’m not bashing ‘Idol’ or Antonella. She’s a beautiful girl and she’s young. I think it’s great that she didn’t have to go through what I went through,” said Davis, who suggested that the show’s producers might have learned from how they treated her. Davis would welcome a public apology from them as “a great start.” But she said she is owed more for “the manner in which I was humiliated and the manner in which Antonella was defended and protected by the same people who humiliated me.”"Now they need to come to the table and see what we can do to make up” for her treatment, Davis said.
